JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 184 of 2014 registered under Sections-376, 307, 379 & other minor sections of the Indian Penal Code.
In course of investigation, independent witnesses stated that the petitioner and the victim were in love and the petitioner established physical relation with the informant by her consent and later on, when the informant became pregnant, the petitioner refused to solemnize his marriage with the informant as a result thereof, the informant lodged the present case. The witnesses have also stated that after institution of the case, the

No.11801 of 2015 (3) dt.30-04-2015 petitioner has solemnized his marriage with the informant but when the informant went to her in-laws, she was subjected to cruelty and was lastly, ousted from her matrimonial home. Moreover, paragraph-17 of the case diary reveals that after supervision, the police has found the case true under Sections-341, 323, 504, 498A, 313/34 of the Indian Penal Code. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dagarua P.S. Case No. 184 of 2014 to the satisfaction of learned Smt. S. Mishra, Judicial Magistrate, Purnea subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
