Public Prosecutor for the State assisted by learned counsel for the informant.

Petitioner seeks bail in a case registered under section 387 of the Indian Penal Code.

According to the prosecution case itself, call of extortion was made through mobile no. 8294041369 and in course of investigation, it came to light that the aforesaid mobile phone stands in the name of one Rukshana Khatoon. It also came to light that one Pradip Singh, who was lodged in jail at that time, talked with the petitioner and on the aforesaid basis petitioner was arrested and confessed his guilt disclosing his involvement in the present crime. Learned counsel for the petitioner submits that there are series of litigation between the petitioner and the informant and several cases have been lodged against the petitioner by the informant

Patna High Court Cr.Misc. No.31151 of 2016 (2) dt.12-08-2016 as well as some others and that is the reason of false implication of the petitioner in the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner is in jail custody since 16.5.2016, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Harsidhi P.S. Case no. 111/2016.
