The petitioner apprehends his arrest in connection with Kopa P.S. Case No. 101 of 2016, registered under Sections 272 and 273 of the Indian Penal Code and Section 47 of the Bihar Excise Act.

The accusation is that on receiving secret information about doing the business of illicit liquor in village Pokhar Bhinda, the informant along with other police personnel reached there. On seeing the police party, some persons started to flee away and in that course, when the informant and other police personnel reached near the house of Satya Deo Manjhi then on seeing police party, Satya Deo Manjhi and Sunil Manjhi

Patna High Court CR. MISC. No.50518 of 2019(2) dt.14-08-2019 2/2 (petitioner) also succeeded to flee away. On search, 23 pouches each containing 200 ml Indian made foreign liquor was recovered from the straw house of Satya Deo Manjhi and petitioner.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the aforesaid country made liquor is said to be recovered from the paddy stray house, which is out side the house of the petitioner and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IX-cum-Special Judge, Excise, Saran at Chapra, in connection with Kopa P.S. Case No. 101 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
