22-08-2016 Heard Sri P.K.Shahi, learned senior counsel, who was assisted by Sri Mrityunjay Kumar, learned counsel for the petitioner and Sri Parmanand Prasad, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 17-05-2016 in Sadar P.S. Case No. 246 of 2016 registered for offence under Sections 406, 419, 420, 467, 468, 379/34 of the Indian Penal Code as well as Section 66(C) of the Income Tax Act, 1961, has prayed for grant of bail.

It was submitted by learned senior counsel for the petitioner that on the basis of written report submitted by one Area Manager of InstaKart Service Pvt. Ltd., an F.I.R. was lodged on an

Patna High Court Cr.Misc. No.32378 of 2016 (2) dt.22-08-2016 2/2 allegation of removal of certain articles of huge amount from the company. It was submitted that petitioner's name has come during investigation only on an allegation that some of the amount was credited to the account of the petitioner. He submits that the petitioner is having clean antecedent and he is a student. Keeping in view the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Md. Azam @ Azam Khan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 246 of 2016.
