Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 21.06.2016 passed in Criminal Misc. No.25669 of 2016 on the ground of recovery of huge quantity of illicit country made liquor from the house of petitioner but submission on behalf of the petitioner is that the petitioner is in jail custody since 06.05.2016 and, as a matter of fact, when earlier, Cr. Misc. No.25669 of 2016 was taken up for hearing by this Court, learned counsel of the petitioner, unfortunately, failed to appear before this Court, as a result of which the proper argument could not be placed before this Court. Considering the aforesaid facts and circumstances as

No.31300 of 2016 (03) dt.17-08-2016 2/2 well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Bagha, West Champaran in connection with Balmiki Nagar P.S.Case No. 29 of 2016.
