JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and State. The petitioner is custody in connection with Baghaila P.S. case no. 23 of 2018 for the offence under Section 363 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is the father of one Rajnish Kumar with whom the informant's daughter eloped. Learned counsel submits that the victim in her statement under Section 164 of the Cr.P.C. has stated that she left for Delhi along with Rajnish Kumar, son of this petitioner. Apart from the fact that the son of the petitioner has accompanied the victim, there is no overt act alleged against this petitioner that he was in any manner instrumental in abduction of the victim girl. The petitioner is in custody since 20.06.2018.

No.54232 of 2018 (2) dt.20-09-2018 2/2 Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each after 20.12.2018 to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub-Judge, Sasaram (Rohtas) in connection with Baghaila P.S. case no. 23 of 2018.
