1. Heard learned counsel for the parties.
2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Chakai P.S. Case no. 284 of 2023 registered for the offence punishable under sections 307, 341, 323, 354, 504 and 506 of the Indian Penal Code.
3. As per allegation in the F.I.R, it is stated that the petitioner started to abuse and assault the informant. As a result of lathi blow given, the informant sustained injury on his head.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR. Referring to the contents of the petition as also the order of the learned trial Court it is submitted that after visiting
Patna High Court CR. MISC. No.54730 of 2024(2) dt.02-09-2024 2/2 the referral hospital, the informant did not go any where else for treatment. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the nature of injury and the petitioner not having any criminal antecedent, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Chakai P.S. Case no.284 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui.
