Petitioner is accused in connection with Siwan Town P.S. Case No. 69 of 2016 registered under Sections 326, 307 of the I.P.C. and 27 of the Arms Act.
The prosecution case is that when the informant came at Mixing Plant after making payment of labourer, two persons came on motorcycle and shot fire at the informant caused injury on his waist. In the light of torch, he identified one Papan Mian, having a pistol in his hand. Thereafter, on the order of another person, Papan Mian also fired upon him, which did not hit the informant.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.27719 of 2016 (2) dt.12-07-2016 2/2 submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been disclosed by accused Papan Mian. Except the confessional statement, there is nothing against the petitioner. It is also submitted that petitioner is in custody since 23.02.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Siwan in connection with Siwan Town P.S. Case No.69 of 2016. Out of two sureties, one surety must be parents or close relatives of the petitioner.
