Petitioner is in custody in connection with Hasanpur P.S. case No. 210 of 2017 for the offence under sections 302, 120(B) of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Referring to Fard-beyan he submits that allegation against this petitioner is that he was one of the three persons who intercepted the motorcycle and on the call of Ramsagar Yadav, Ravish Yadav fired which caused death of the son of the informant.

Learned counsel further submits that there is no overt act alleged against this petitioner. The petitioner is in custody since 18.7.2018.

No.54791 of 2018(2) dt.28-09-2018 2/2 Considering the aforesaid, let the petitioner, named above, be enlarged on bail after 21.10.2018 on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 3rd, Rosera, Samastipur, in connection with Hasanpur P.S. Case No. 210 of 2017.
