JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.
Petitioners apprehend their arrest in connection with Muffasil Police Station Case No. 23 of 2015 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 506 of the Indian Penal Code.
There is allegation against the petitioner no. 1 that he gave iron rod blow causing head injury to the informant and so far as petitioner no. 2 is concerned, it is alleged that he committed theft of belongings of the informant. The injury report of informant reveals that he sustained altogether three injuries which
Patna High Court Cr.Misc. No.21101 of 2015 (2) dt.03-07-2015 2/2 are said to be simple in nature caused by hard and blunt substance. Considering the aforesaid facts and circumstances as well as submissions of the parties, the petitioner no. 2 Krishnandan Sigh @ Kisho Singh, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Muffasil Police Station Case No. 23 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
So far as the petitioner no. 1 is concerned, his prayer for grant of anticipatory bail stands rejected. However, if petitioner no. 1 Pappu Singh surrenders and seeks regular bail before the court concerned within four weeks from today, the concerned court shall consider the regular bail application of petitioner no. 1 on its own merit particularly keeping in mind that petitioner no. 1 Pappu Singh is said to have given one iron rod blow causing simple injury to the informant.
