The matter has been taken up through virtual Court proceeding.
Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 386/34 of the Indian Penal Code and Section 27 of the Arms Act.
At the time of occurrence of assault, the petitioner and some other co-accused were carrying lathi whereas allegation of giving stab wound with a barchi is against other named persons. The Doctor has found two stab wounds besides a laceration at the back of the body.
Learned counsel for the informant opposed the
Patna High Court CR. MISC. No.8607 of 2021(2) dt.24-06-2021 2/3 prayer for bail on the ground that since the deceased had reported the matter of illegal business of liquor being done by the petitioner and others that was the reason of commission of murderous assault. Moreover, the witnesses are getting threat at the hands of the accused persons including the petitioner. Further the petitioner has got criminal antecedent. Considering the nature of allegation against the petitioner and non-corroboration of the same by the medical evidence as well as the fact that the petitioner is in custody since 13.06.2020, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.
20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T. No. 108 of 2020 arising out of Benipatti Police Station Case No. 133 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without
