====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-07-2016 It is yet another case, in which the petitioner is in custody in connection with possession of illegal liquor, none has appeared on behalf of the State.
Heard Sri Y.C.Verma, learned Senior Counsel, who was assisted by Sri Paras Nath, learned counsel for the petitioner. The sole petitioner, who is in custody in connection with Mehandia P.S. Case no.45/2016 registered for the offence under Section 273 of the Indian Penal Code and 47 of the Excise Act, has prayed for grant of bail.
Learned counsel for the petitioner submits that no recovery was affected from the conscious possession of the petitioner. He submits that it was falsely alleged that countrymade liquor was recovered from the premises of the petitioner.
Patna High Court Cr.Misc. No.26764 of 2016 (2) dt.12-07-2016 2/2 Keeping in view the nature of accusation as well as the fact that there is no opposition on behalf of the State, let the petitioner, namely, Laldeo Prasad be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Mehandia P.S. Case no.45/2016.
