JUSTICE SATYAVRAT VERMA ORAL ORDER 28-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Bettiah Town Kalibag O.P. P.S. Case No. 403 of 2021 instituted for the offences under Section 414 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2021, charge-sheet has been submitted in the case and he has got criminal antecedent of two cases as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that allegation is of recovery of 7 litres of liquor from dickey of the motorcycle which the petitioner was riding.

It is further submitted that despite there being nothing in the dickey, police maliciously implicated him in the present case.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.07.2021, charge-sheet has been submitted in the case and allegation is of recovery of 7 litres of liquor from the dickey of the motorcycle, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Bettiah Town Kalibag O.P. P.S. Case No. 403 of 2021.
