This application for grant of regular bail arises out of Muzaffarpur Rail P.S. Case No.138 of 2021 registered for the offence punishable under Sections 307, 328, 379 of the Indian Penal Code.
The petitioners are alleged to have given some intoxicant/medicine to the informant and others when they came out from railway station.
It seems that the petitioners are members of Jahar Khurani Gang. They have antecedent of similar nature. This kind of crime is common on the railway stations and the people are loosing their lives.
Patna High Court CR. MISC. No.52137 of 2022(2) dt.16-12-2022 2/2 Though the learned counsel for the petitioners has relied upon an order of this Court dated 17.08.2022 passed in Cr. Misc. No. 13733 of 2022, by which co-accused Awadhesh Kumar has been granted bail but the aforesaid order does not reflect that the person who has been granted bail was having antecedent of similar nature.
In view of the above, I am not inclined to grant the petitioners privilege of regular bail.
Accordingly, this bail application is dismissed. The Court below is directed to conclude the trial expeditiously preferably within a period of one year from the date of receipt/production of a copy of this order. (Sandeep Kumar, J) Guddu/- U
