1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Kabaiya P.S. Case No. 77 of 2025 dated 10.03.2025 registered for the offence under section 126(2), 115(2), 109(1), 117(2), 352, 3(5) of the Bharatiya Nyaya Sanhita 2023.
3. As per the first information report on 10.03.2025 at about 08:00 A.M. the informant left his house for his work and when he reached on the road in the meantime petitioner no. 1- Ajit Ram, petitioner no. 2 - Chandan Ram and petitioner no. 3 - Sahil Kumar suddenly came there and demanded extortion money and started quarreling and abusing. The petitioner no. 1

No.55279 of 2025(2) dt.27-08-2025 2/3 assaulted by means of iron rod upon his head due to which his head was broken and petitioner nos. 2 and 3 assaulted upon his leg by 'lathi' and 'danda' due to which his left leg got fractured. It is also alleged that they assaulted upon his face by means of 'danda' due to which his right jaw got fractured.
4. Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence in the manner alleged. Both the parties are co-villagers and due to village politics the petitioners have falsely been implicated in the instant case. He submits that the fact of the matter is that the informant had taken a loan of Rs. 5000/- from the petitioner no. 1 for doing work but the informant neither performed the work nor returned the money and upon demand of money some hot exchange of words took place and with the help of Kabaiya Police the informant lodged false and fabricated case against the petitioners.

Regard being had to the submissions made by the parties and taking into consideration the nature of allegation and upon perusal of the impugned order where it is mentioned that injury report of the informant reveals that the informant has got as many as three injuries on his head, one is on his chin and other is on his left leg, his external auditory canal and right
Patna High Court CR. MISC. No.55279 of 2025(2) dt.27-08-2025 3/3 mandibular condoyle got fractured, the leg bones, tibia and fibula were also fractured which indicates that injuries are grievous in nature, accordingly, I am not inclined to grant anticipatory bail to the petitioners.
