Petitioner apprehends his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition & Excise Act.

As per the prosecution case, 10 liters of foreign liquor has been recovered from the hut of this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The hut in question does not belong to this petitioner and recovery has been made on the basis of confessional statement of co-accused.

Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that the petitioner has

Considering the criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
