Petitioner seeks bail in Bhabhua P.S. Case No.398 of 2018 instituted for the offence under Section(s) 366-A/34 Indian Penal Code and Section 6 of the POCSO Act. It has been submitted that petitioner has been named in the First Information Report only on the basis of suspicion. In the written report, informant has alleged that he learnt during search that his daughter has been kidnapped by this petitioner along with others.

Statement of the victim has been recorded under Section 164 Cr.P.C., which has been annexed as Annexure-3, wherein, she has stated that she has not been kidnapped. She has voluntarily married with Vikash Singh, son of this petitioner.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st-cumSpecial Judge, POCSO, Act, Kaimur at Bhabhua, in connection with Bhabhua P.S. Case No.398 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
