JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-09-2018 The petitioner seeks bail in connection with Sour Bazar (Baijnathpur Police Shivir) P.S. Case No. 274 of 2018 dated 11.05.2018 instituted for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Approximately 133 litres of liquor, both local as well as indian made foreign liquor, were recovered from a vehicle of which the petitioner is stated to be one of the owners.

Patna High Court Cr.Misc. No.54565 of 2018(2) dt.04-09-2018 2/2 The learned counsel for the petitioner has submitted that petitioner was not arrested from the spot. The petitioner did not know that the two other owners of the said vehicle had permitted the vehicle to be used for the purposes of transporting liquor.

The petitioner is in custody since 21.07.2018. For the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Saharsa-cum-Incharge, Special Judge, Excise, Saharsa in connection with Sour Bazar (Baijnathpur Police Shivir) P.S. Case No. 274 of 2018.
