JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 353, 307, 401, 411, 414, 420, 467, 468, 216(A) and 120(B) of the I.P.C.

Allegedly, a raid was conducted but 2 to 3 associates of Rama Nand Paswan succeeded in fleeing away. Further Rama Nand Paswan was apprehended though he tried to push contable Manoj Paswan and also tried to snatch his pistol and on the basis of disclosure made by Rama Nand Paswan, other co-accused were apprehended with looted mobiles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.1.2016 and the charge sheet has been submitted in the present case. The petitioner has got no

Patna High Court Cr.Misc. No.32701 of 2016 (3) dt.17-09-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no compliance of Section 100 of the Cr.P.C. The other co-accused have been granted bail vide Cr.Misc.No.28779 of and Cr.Misc.No.12731 of 2016.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Town P.S. case No.18 of 2016.
