The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Gopalganj Town P.S. Case no. 269 of 2021 instituted for the offence under Sections 341, 323, 324, 326, 307, 379, 504, 109/34 of the Indian Penal Code.

As per allegation in the FIR, when the informant and his brother were coming to their house and reached near the house of Bhikham Sah then due to previous enmity several accused persons including the petitioner surrounded them and started to abuse and assault them. It is further alleged that they took the wrist watch and golden chain of informant and his brother.

Learned counsel appearing on behalf of the petitioner has

Patna High Court CR. MISC. No.61853 of 2021(2) dt.21-06-2022 2/2 submitted that petitioner is innocent and has committed no offence. Specific allegation of giving order is against co-accused Raja Lal Bhagat. All the three injured persons were treated at Sadar Hospital and doctor has found simple injury except one on Digvijay Singh. There was free fight between both the parties and members of both side have received injuries.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Gopalganj (Town) P.S. Case no. 269 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj subject to the conditions as laid down under section 438(2) of the Cr.P.C.
