JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code.
Petitioner was caught with stolen motorcycle but submission on behalf of the petitioner is that the seized motorcycle belongs to one Jabbu Yadav and, as a matter of fact, the aforesaid motorcycle was being driven by aforesaid Jabbu Yadav and petitioner was pillion rider but seeing the police party, said Jabbu Yadav fled away from there leaving behind the seized motorcycle and petitioner was caught on the spot.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named
Patna High Court Cr.Misc. No.27757 of 2016 (3) dt.26-09-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Katihar in connection with Rautara P.S. Case No.19 of 2016.
