The petitioner is languishing in custody for the offences punishable under Sections 20/22 of the N.D.P.S. Act. 15 kilograms of Ganja was allegedly recovered from the possession of the petitioner. Petitioner is in custody since 04.11.2017. Investigation of the case is already complete. Earlier prayer for bail was refused on 27.08.2018 with direction to the learned trial Judge to expedite the trial and conclude the same preferably within nine months, failing which the petitioner would be at liberty to renew the prayer before the trial Court.
Considering the chances of non-conclusion of trial in
Patna High Court CR. MISC. No.51352 of 2019(3) dt.28-08-2019 2/2 near future and period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.165 of 2017, arising out of Agam Kuan P.S. Case No.561 of 2017, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
