The petitioner apprehends his arrest in connection with Awatar Nagar P.S. Case No.123 of 2020 instituted under Sections 304(B), 201, 34 of the IPC.
As per the prosecution story, the petitioner was married to Poonam Kumari in 2018 but later was tortured for dowry and subsequently the allegation is that on 23.05.2020, she was killed. Accordingly, the FIR was lodged.
Learned counsel for the petitioner submits that she died of illness due to excess bleeding but the same has been given the colour of killing only to extract money. Be that as it may, petitioner is the husband and having failed to take up the responsibility of the wife, going by the allegation, this Court is not inclined to grant him relief, which is
Patna High Court CR. MISC. No.52165 of 2022(2) dt.17-01-2023 2/2 accordingly rejected.
If the petitioner surrenders within four weeks from today, the court shall take into account the documents that the petitioner is able to show for the grant of bail and the same shall be disposed of without prejudiced by any observation made herein.
