2. The petitioner is in custody in connection with Hathauri P.S. Case No. 78 of 2023 for the offence under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)A, 26, 35 of the Arms Act.

3. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 17.04.2023.

4. While planning to commit loot, the petitioner along with accused persons were got arrested and there is recovery of one live cartridge from possession of the petitioner.

5. Considering the fact that the petitioner has got no criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the

Patna High Court CR. MISC. No.54687 of 2023(2) dt.25-08-2023 2/2 like amount each to the satisfaction of learned Judicial Magistrate-1st Class, East Muzaffarpur in connection with Hathauri P.S. Case No. 78 of 2023.

The petitioner will visit Ahiyapur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
