2. The petitioner apprehends his arrest in a case, registered for offence punishable under Section 316(5) of the B.N.S., 2023.
3. As per F.I.R., the allegation against petitioner is that he, after retirement from the post of U.D.C. on 31.12.2024, did not hand over the charge in spite of several directions.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence. Petitioner has already retired on 31.12.2024 from the service and he has already handed over charge as well as keys of the Almirah, in which, all the concerned files are kept to Saiyad Iqbal Hasan on the instruction of incharge Superintendent.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that this petitioner, in spite of repeated orders of higher officers, did not hand over the charge and as such, the department could not file proper affidavit in C.W.J.C. No. 19383 of 2024, filed on behalf of Laxmi Narayan in this Hon'ble High Court, and thus, petitioner disobeyed the direction of higher officials and caused hindrance in discharge of official duty.
6. Considering the nature of accusation, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
