Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 323, 341, 307, 504, 506 of the Indian Penal Code. In the background of land dispute coaccused Basand Yadav assaulted Chandradeep Yadav on his head whereas this petitioner assaulted Bulanti Devi on her head when Vikash Yadav assaulted Chando Yadav on her head. It is submitted by learned counsel for the petitioner that though some of the injuries of Bulanti Devi has been found to be grievous but the case lodged by the petitioner's side is at earlier point of time and there is nothing to suggest that petitioner had any intention to kill Bulanti Devi. Patna High Court Cr.Misc. No.23074 of 2015 (2) dt.13-07-2015 2/2 petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks in connection with Pakribarawan P.S. Case No. 9 of 2015, pending in the Court of learned Chief Judicial Magistrate, Nawada.

With the observations above, the application stands disposed off.
