JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Kudra P.S. case no. 255 of 2018 instituted for the offence under Section(s) 366A/34 Indian Penal Code.

Learned counsel for the petitioner has submitted that victim girl has given her statement under Section 164 Cr. P.C. wherein she has stated her age to be 17 years. She has stated that she was taken by this petitioner to Mumbai and she lived with this petitioner for 11 months. This petitioner has also established physical relationship with her. Thereafter this petitioner with another boy , namely, Deepak brought her to Sasaram. It is further submitted that it is a matter of love affairs between the parties. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-1st Kaimur at Bhabua, in connection with Kudra P.S. case no. 255 of 2018, in POCSO Case no. 29 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
