Petitioner seeks bail in a case registered for the offences punishable under Section 395 IPC.

The FIR of the occurrence of dacoity is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused. Petitioner is in custody since 28.02.2020. Investigation of the case is already complete. Submission is that neither the petitioner was put on T.I. Parade during investigation of the case nor any incriminating article was recovered from his possession. Only due to his criminal antecedent, the petitioner has been booked in this case.

Considering lack of sufficient material in this case against the petitioner for further detention as undertrial prisoner,

Patna High Court CR. MISC. No.8509 of 2021(3) dt.24-07-2021 2/2 let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Piro Police Station Case No.272 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
