Petitioner seeks bail in Laukahi P.S. Case No. 184 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 366A, 354 and 504 of the Indian Penal Code.

Informant in his written complaint has stated that on 31.08.2017 at about 9:00 am his sister Mamta Kumari went to coaching and she return at about 12:15 am and narrated that accused Phuldeo Yadav and co-accused Gopal Yadav had took her on motorcycle. Thereafter when his cousin brother Lalu Yadav stopped petitioner and enquired about the incident, petitioner along with FIR named accused persons variously armed came and assaulted them.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.54410 of 2018(2) dt.05-10-2018 2/3 Annexure-4 is the injury report from which it appears that the injuries are simple in nature. There is land dispute between the parties. This case is counter blast of Laukahi P.S. Case No. 185 of 2017. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 27.02.2018 in Criminal Miscellaneous No. 11413 of 2018 and 02.07.2018 in Criminal Miscellaneous No. 23839 of 2018. Petitioner is in custody since 04.07.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned SDJM, Jhanjharpur, Madhubani, in connection with Laukahi P.S. Case No. 184 of 2017, with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be sufficient to cancel his bail bond.

(3) If the petitioner tampers with the
