Mr.Abhay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioner seeks bail in connection with Danapur P. S. Case No. 827 of 2017, for the offences punishable under Sections 420, 406, 468, 471, 120B of IPC.

Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 24.07.2018 passed in Criminal Misc. No.40 727 of 2018.

The fresh application for grant of regular bail has been filed by the petitioner on the ground that other accused persons have been granted bail by a Co-ordinate Bench of this Court, vide order dated 04.07.2018 passed in Criminal Misc. No. 24565 of 2018.

Submission of learned counsel for the petitioner is that petitioner is in custody since 04.01.2018. Heard learned APP as well as learned counsel for the

Patna High Court CR. MISC. No.51240 of 2019(4) dt.25-09-2019 2/2 opposite party no.2. It has been submitted that other accused persons have been granted bail on the basis of compromise reached between complainant and the petitioner and earlier prayer for bail of the petitioner was rejected in another case also.

Having heard both sides, in view of the facts and circumstances, as stated above and also considering the facts that other accused persons have been granted bail and the petitioner is in custody for more than one and half year, let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Danapur P. S. Case No. 827 of 2017, with condition that he has to appear as and when required by the learned trial court, otherwise, the prosecution is at liberty to move for cancellation of his bail bonds.

With the above observations, this application is allowed.
