Mr. Choubey, learned advocate seeks permission to withdraw this application with respect to the petitioner no.2 who has been arrested during the pendency of this application. The application with respect to petitioner no.2 is dismissed as having become infructuous.

The petitioner nos. 1 & 3 seek bail in anticipation of their arrest in connection with Supaul P.S. Case No. 739 of 2019 dated 21.11.2019 instituted for the offences under Sections 420,

Patna High Court CR. MISC. No.8650 of 2021(3) dt.09-03-2022 2/3 467, 471, 120(B) of the Indian Penal Code.

The petitioner nos. 1 & 3 had applied for being made agents on contractual basis for executing the government project. However, on scrutiny of their application forms, it was found that the certificates furnished by them of Bundelkhand University was forged and fabricated.

Learned counsel for the petitioners has submitted that they have not been selected as Contractors and that no loss has been caused to any government agency. The petitioners deny that their certificates, which were furnished by them, are forged and fabricated. The petitioners did not get any opportunity to demonstrate their bonafides.

Be that as it may, considering the facts that the petitioner nos. 1 & 3, namely, Manoj Kumar Singh and Basant Kumar could not take advantage of the academic qualification which has only prima facie been found to be forged, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
