JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Samastipur Mahila P.S. Case No. 45 of 2018 registered for the offences punishable under Sections 323, 341, 376, 379 and 504/34 of the Indian Penal Code. Prosecution story is that one Masoom, younger brother of the petitioner, made physical relationship with the informant on the assurance of marriage but the petitioner prevented him from marry with her and also demanded Rs.4 lac. Submission of learned counsel for the petitioner is that the main allegation of having physical relationship is against his younger brother and he has falsely been implicated with intention to create pressure upon the brother of the petitioner to marry her and other allegations are general in nature.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Ranjan, Judicial Magistrate, 1st Class, Samastipur, in connection with Samastipur Mahila P.S. Case No. 45 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner will not make any threat to the informant, otherwise she is at liberty to move for cancellation of bail bonds of the petitioner before the court below itself.
