JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 498A of the Indian Penal Code and 3 /4 of D.P.Act.
The allegation against the petitioner is of torturing the informant for non fulfillment of additional demand of dowry. On behalf of the petitioner it has been submitted that the petitioner is the husband of the informant. It is further submitted that the petitioner is ready to keep the informant as his wife with full dignity and honour. It is also submitted that the petitioner is ready to deposit an amount of Rs.2000/- (two
Patna High Court Cr.Misc. No.22148 of 2015 (4) dt.02-09-2015 2/2 thousand) per month in the court below, which may be released in favour of the informant.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 2000/- (two thousand) per month in the court below, which shall be released in favour of the informant.
Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sasaram, Rohtas in connection with Ssheosagar P.S.case No. 294 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
