JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 17.02.2016 in connection with Paliganj P.S. Case No. 29 of 2016 registered for offences under Sections 147,148,149 and 302 of the Indian Penal Code and 27 of the Arms Act.

The prosecution story, in brief, is that on 15.02.2016 at 6.30 P.M. when the father of the informant was returning to his house and as soon as he reached at N.H. 98 between Mahabalipur and Ankuri village, accused persons namely, Sanjay Rajwara, Shiv Payare Verma, Jhullan Rajwara, Rambalka Rajwara, Radhe Paswan Shakti Paswan, Sunane Rajwara murdered the father of the informant namely, Shiv Narayan Rajwar by fire arm injury. Patna High Court Cr.Misc. No.28703 of 2016 (3) dt.30-08-2016 is in custody since 17.02.2016. Charge-sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. There is only one gun shot injury found on the body of the deceased. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Danapur in connection with Paliganj P.S. Case No. 29 of 2016.
