JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code.

It is alleged on 03.12.2014 that while the informant after withdrawing rupees twenty thousand under Indira Awas scheme came out of the bank, the petitioner took Rs.10/- out of the withdrawn amount to give illegal gratification to BDO and District Magistrate.

It is submitted by the learned counsel for the petitioner that for the occurrence of 3.12.2014 the FIR was registered on 19.2.2015 and there is no proof with regard to any payment to the petitioner.

Patna High Court Cr.Misc. No.22274 of 2015 (2) dt.21-05-2015 2/2 It is submitted by learned counsel for the informant that rupees ten has wrongly been incorporated in the FIR instead of rupees ten thousand but failed to explain the delayed lodging of the FIR.

Considering the delayed lodging of the FIR, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jehanabad in connection with Karpi P.S. Case No. 30 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
