The prayer for bail of the petitioner in a criminal prosecution originally registered under Section 302/201 of the Indian Penal Code, in which subsequently chargesheet was submitted under Sections 396 and 412 of the Indian Penal Code, was earlier rejected by this Court by order dated 25.05.2015 (Annexure-1) passed in Cr.Misc.No. 19695 of 2015 with an observation that if the trial of the petitioner is not concluded within a period of one year from the date of framing of charge, then he shall be at liberty to renew his prayer for bail. By order dated 03.08.2016 a report was called for from the learned trial court which has been received and has been kept at Flag 'A'. From the perusal of the aforesaid report, it appears that period of one year from the date of framing of charge has not expired. It further appears that the petitioner is accused in two more criminal cases, out of which, one is relating to robbery allegedly committed by him..
In the aforesaid factual matrices, the prayer for bail of
Patna High Court Cr.Misc. No.32083 of 2016 (3) dt.21-09-2016 2/2 the petitioner in connection with Pothia (Paharkatta) P.S.Case No. 95 of 2012 giving rise to Sessions Trial No. 422 of 2015 pending in the court of learned Additional Sessions Judge 1st, Kishanganj is once again rejected.
The learned trial court is directed to make all endeavours to conclude the trial of the petitioner at an early date preferably within a period of nine months from the date of receipt/production of a copy of this order.
