2. Learned counsel for the State Shri Jharkhandi Upadhyay has filed counter affidavit in this case.

3. This is the second attempt of the petitioner for grant of regular bail in connection with NDPS Case No. 36 of 2023 arising out of Laheriyasarai P.S. Case No. 428 of 2023 registered for the offence under Sections 385, 414/34 of the Indian Penal Code and also under Section 8(c), 20(b)(ii)(c), 22(c), 23(c), 25 and 29 of the NDPS Act.

4. As per the prosecution case, there if recovery of 1.100 Kg. of Ganja. It has also been alleged that the extortion of Rs. 50 Lakh was demanded from a doctor and the phone from which the extortion call was made, belongs to the petitioner.

5. It has very fairly been submitted by the learned counsel for the petitioner that the trial has started and four witnesses have already been examined in this case.

6. Considering the nature allegations levelled against the petitioner and also considering the fact that the trial of the petitioner is progressing, this Court is again not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Court below is directed conclude the trial of the petitioner at the earliest.
