The sole petitioner, who is in custody in connection with Nawakothi P.S. Case No. 21 of 2016 registered for the offence under section 302, 328, 307, 323, 341, 337, 338/34 of the Indian Penal Code, has prayed for grant of bail. Learned counsel for the petitioner by way of referring to the F.I.R. submits that save and except the fact that the name of the petitioner has been incorporated in the column of the accused, nothing specific accusation has been made. He further submits that even in the F.I.R. it was alleged that one apple was given to the son of the informant by the daughter of the petitioner
Patna High Court Cr.Misc. No.26776 of 2016 (2) dt.12-07-2016 2/2 which was allegedly poisonous. He further submits that during investigation the informant herself has stated that in view of influence of her family members, she had lodged the case. Besides hearing, I have perused the F.I.R. After going through the F.I.R. the court is satisfied that it is a fit case for extending the privilege of bail.
Let the petitioner Samari Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri Vineet Kumar Singh, Judicial Magistrate 1st Class, Begusarai /concerned court in connection with Nawakothi P.S. Case No. 21 of 2016.
