JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Naubatpur P.S. Case No. 214 of 2018 registered for the offences punishable under Sections 420, 120B/34 of the Indian Penal Code and section 7 of Essential Commodities Act.

The petitioner happens to be driver of the truck bearing truck No. UP 21 AN 1867 which was laden with 450 bags of rice and proceeded to Naubatpur Block from CMR Godown Bihta but unfortunately fell in a canal and, thereafter the informant being Block Supply Officer lodged this case and seized the aforesaid bags of rice which were carried for selling in black market.

Patna High Court Cr.Misc. No.57101 of 2018 (2) dt.20-09-2018 2/2 Submission on behalf of the petitioner is that the petitioner immediately gave information to his agent after the above stated accident and after that the district manager, Patna sought permission for sending the seized rice to its destination through another truck and, therefore, the aforesaid facts indicate the innocence of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-1st, Danapur in Naubatpur P.S. Case No. 214 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
