JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
The marriage of deceased had taken place with petitioner no. 1 eight years ago. The death of deceased is not natural and the doctor opined that cause of death of the deceased was asphyxia due to strangulation.
In course of investigation, some witnesses stated that petitioner no. 1 was a drunkard and he used to quarrel with the deceased and on the alleged date of occurrence, a quarrel had
Patna High Court Cr.Misc. No.30281 of 2016 (3) dt.06-10-2016 2/2 taken place between the deceased and petitioner no. 1 and thereafter, deceased committed suicide in an orchard. The investigation against the petitioners has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, Judicial Magistrate 1st Class, Muzaffarpur in connection with Kanti P.S.
