Petitioner, who is in custody, seeks bail in connection with Motipur P.S. Case No. 453 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 447, 323, 504, 427, 395, 295, 354, 354(B) and 436 of the Indian Penal Code and under Section 27 of the Arms Act. Informant has alleged that when he was talking with his younger brother at his door, petitioner along with 42 FIR named co-accused and 200-300 male and female of his village came with lathi, farsa, iron rod, petrol and kerosene oil and started assaulting them looted Rs. 8-10 lacs and animals and also tried to commit rape upon female members. It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.56110 of 2018(2) dt.06-10-2018 2/2 that he is innocent and has committed no offences. He has been falsely implicated in this case due to previous enmity. There is no specific allegation against the petitioner. Petitioner and informant are neighbour. He has no criminal antecedent and he is in custody since 22.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Muzaffarpur in connection with Motipur P.S. Case No. 453 of 2018.
