JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mohania P.S. Case No. 210 of 2019 registered for the offences punishable under Sections 366A and 504 of the Indian Penal Code.

Allegation is of kidnapping of minor daughter of the informant and it appears that her statement has been recorded under Section 164 Cr.P.C. in which she has made allegation against the petitioner of kidnapping and also of having physical relationship.

Submission of learned counsel for the petitioner is that as a matter of fact the matter has been compromised and she is residing with the petitioner and further as per Matriculation certificate she is aged 17 years 8 months.

Patna High Court CR. MISC. No.48159 of 2019(2) dt.05-08-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and pray for regular bail, the same shall be considered on the basis of materials available on the record and the submission made above. With the above observation, this application is dismissed.
