JUSTICE SANJAY PRIYA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Katihar Town P.S. Case No. 681 of 2017 instituted for the offence under Section 302 of Indian Penal Code pending in the court of Chief Judicial Magistrate, Katihar.
In the written report there is specific allegation against the petitioner of assaulting father of the informant with bricks on head causing bleeding injury. Father of the informant was brought to the Hospital but during treatment he died. The occurrence took place on account of demanding price of Bhunja from the petitioner.
The Sessions Judge has mentioned in the impugned order that Doctor has found three injuries on the person of the
Patna High Court Cr.Misc. No.55728 of 2018 (2) dt.08-10-2018 2/2 deceased and cause of death was due to haemorrhage and neurogenic shock caused by hard and blunt substance. Counsel for the petitioner submits that name of father of petitioner is Prakash Jha @ Subodh Acharya, but in the First Information Report his name has been mentioned as Prakash Jha. In the written report there is specific allegation against the petitioner that he assaulted father of the informant. Therefore, this Court is not inclined to grant bail to the petitioner.
Prayer for bail of the petitioner stands rejected at this stage.
