The petitioner is in custody since 18.7.2018 in connection with Ujiarpur P.S. Case No. 163 of 2018 registered for the offence punishable under Section 272, 273 of the I.P.C and Section 30 (a), 38 (1), 38 (2) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Petitioner was arrested in connection with seizure of 96 liter bear and 8.640 liter of Whisky. Learned counsel for the petitioner submits that petitioner was not aware of the fact that liquor kept in the house. In fact, his son was aware of the fact that liquor was kept inside the house. He submits that the son of the petitioner was granted

Patna High Court Cr.Misc. No.54824 of 2018(2) dt.28-09-2018 2/2 anticipatory bail by this Court in Crl Misc. No. 56031 of 2018. Considering the fact that petitioner has no criminal antecedent and has remained in custody for more than two months, let the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge VI-cum- Special Judge, Excise, Samastipur in connection with Ujiarpur P.S. Case No. 163 of 2018.
