Heard learned counsel for the petitioner, informant and the State.

The petitioner seeks bail in a case instituted under Sections 341, 376 and 506 of the Indian Penal Code. Allegation against the petitioner is of committing rape upon the informant.

It has been submitted on behalf of the petitioner that he is in custody since 18.5.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. The F.I.R. has been instituted after three months of the occurrence. The medical report does not support the allegation made in the F.I.R. Vide Annexure-5 to the supplementary affidavit the informant has filed a compromise petition dated 21.5.2016 in the court below. The independent witnesses in paras58 to 61 of the case diary have stated regarding the false implication of the petitioner in the present case.

Patna High Court Cr.Misc. No.30485 of 2016 (3) dt.15-09-2016 2/2 On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R. The signature of the informant on the complaint petition is not denied by the learned counsel for the informant.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Patna Mahila P.S. Case no. 22 of 2016.
