JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2022 The present writ petition has been filed seeking the following reliefs:- "That the present writ petition has been filed on behalf of the petitioner for issuance a writ, order or direction including a writ in the nature of Mandamus commanding to the respondents for remove the encroachment of Mauza-Sapoua Basauli Thana No. 98, Khesra No. 215 and nature of land belongs to Sarv Sadharan Anabad for which land Encroachment Case No. 05 of 2018 has been instituted by Circle Officer, Rosra and notice issued to all encroacher but till date no any encroachment was removed by the respondents and ingress and egress of the petitioner was stopped by encroacher and/or may be pass other relief which the petitioner

Patna High Court CWJC No.18364 of 2021(2) dt.08-09-2022 2/2 is entitled to and/or may be pass other and further order or direction in which the petitioner is entitled to."

The limited prayer of the petitioner in the present case is to direct the Circle Officer, Rosera, District-Samastipur to conclude the proceedings of the Encroachment Case No. 5 of 2018, expeditiously.

Having regard to the limited prayer made by the learned counsel for the petitioner, the Circle Officer, Rosera, District-Samastipur is directed to conclude the proceedings of the aforesaid Encroachment Case No. 5 of 2018, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Case, 1956, in accordance with law and after hearing the affected parties, within a period of 12 weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
