Petitioner who happens to be an army personnel was interrogated by the informant whereupon he had disclosed that being an army personnel, he is in possession of four bottles of foreign wine. Furthermore, it has also been disclosed that two bags were found beneath the seat and on checking, from one bag 16 bottles of foreign wine while 11 bottles from another bag were recovered.

Petitioner is under custody since 14.06.2016. In the aforesaid facts and circumstances of the case, petitioner, Santosh Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Railway, Gaya in connection with Gaya (Rail) PS Case No. 132/2016.
