2. The petitioner seeks regular bail in connection with Madhuban P.S. Case No. 18 of 2014 registered for the offence under Section(s) 307 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner is accused in a case in which he was in the jail on the alleged date of occurrence. Some accused persons fired upon the victim but the victim did not sustain any injury. The crime was committed for demanding the extortion money.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 03.07.2015. Nothing has been

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and the period of custody, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 1,00,000/- (Rs. One Lakh) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Motihari, East Champaran in connection with Madhuban P.S. Case No. 18 of 2024 subject to conditions that:- (i). The petitioner will mark his attendance at the Madhuban Police Station on Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner;
(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner;
(iii) Both the bailors should be the family members/relatives of the petitioner who shall provide official document to show his/her relationship;
(Iv). The photographs of the
