2. Petitioner seeks regular bail in connection with Semra P.S. Case No. 42 of 2024 dated 05.06.2024 registered for the offence punishable under section 302 read with section 34 of the Indian Penal Code
3. The main submissions advanced by petitioner's counsel are that the petitioner and other co-accused persons have been made accused in connection with the death of the informant's wife merely on suspicion and further, they have been implicated on account of the disappearance of the informant's son with the daughter of this petitioner and that incident took place ten days prior to the alleged occurrence of the present case. It is further submitted that in the FIR there is

No.58044 of 2025(3) dt.17-12-2025 2/3 no specific allegation against the petitioner and other co-accused persons namely Bhola Sahani, Suresh Sahani and Kallu Sahani @ Dhananjay Kumar, carrying similar nature of allegation, have been granted bail by a co-ordinate bench of this Court vide orders dated 21.03.2025 and 17.03.2025 passed in Cr. Misc. Nos. 74694/2024 and 72991/2024 respectively. It is further submitted that the informant's wife was not killed rather she committed suicide and the petitioner and other co-accused persons were made accused mainly on account of previous dispute and enmity. It is lastly submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 16.04.2025 and against him the investigation has been completed.
4. Learned APP for the State has opposed the prayer of the petitioner.
5. Considering the aforesaid submissions and mainly the petitioner's custody period, his fair and clean antecedent and the privilege of bail having been granted to above mentioned coaccused persons and coupled with completion of investigation against him, this Court is inclined to release him on bail.
