JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pauthu P.S. Case No. 16 of 2018 registered for the offences punishable under Section 379 of the Indian Penal Code, Sections 4(1)/ 4(1A) of M.M.D.R. Act and Sections 26(A)/27/40 of B.M.M.C Rules, 1972.

Allegation against the petitioner is that he is running the brick kiln without having proper licence. Submission of learned counsel for the petitioner is that he has applied for the licence and at present he is not running the brick kiln and he has falsely been implicated and he is ready to abide by any condition that may be imposed on him. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail

Patna High Court CR. MISC. No.49258 of 2019(2) dt.07-08-2019 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Aurangabad, in connection with Pauthu P.S. Case No. 16 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that he has to obtain licence prior to running of brick kiln.
